1. Overview of the Service

PandaChecks allows users to upload videos (MP4), generate transcripts, and unlock an AI-powered analysis report through either:

• watching a rewarded advertisement, or
• paying for a future paid unlock option (if enabled)

The Service includes temporary audio processing, AI transcription, and AI-generated media analysis reports.

2. Eligibility

• You must be at least 13 years old to use PandaChecks.
• You must be at least 18 years old to make purchases or enter into binding agreements on this platform.
• If you use PandaChecks on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. User Responsibilities

By using PandaChecks, you agree that you will not:

1. Upload content that is illegal, harmful, harassing, violent, pornographic, or otherwise prohibited by law.
2. Upload copyrighted material that you do not have permission to use.
3. Attempt to reverse engineer, copy, or scrape the Service.
4. Interfere with the performance, security, or integrity of the platform.
5. Attempt to bypass ads, billing, or rate limits.
6. Use the Service for political harassment, doxxing, misinformation campaigns, or targeted disinformation.

You are responsible for all content you upload and all activity under your use of the Service.

4. Video Uploads & Content Rights

You retain all ownership rights to the videos you upload.

By uploading a video, you grant PandaChecks a limited, temporary, non-exclusive license to:

• store the file
• process it
• generate transcripts
• generate analysis reports
• serve the finished result back to you

We do not claim ownership of your videos or transcripts.

We do not share uploaded content with third parties except as required to provide the Service (e.g., OpenAI for transcription/analysis).

Uploaded files may be deleted automatically after processing. Transcripts and reports may remain stored until you request deletion.

5. AI-Generated Content Disclaimer

PandaChecks uses AI models to produce transcripts and analysis.

You acknowledge and agree that:

• AI output may contain errors, inaccuracies, or interpretations you disagree with
• AI output should not be considered legal, medical, or professional advice
• PandaChecks is not liable for decisions made based on AI-generated information
• You are solely responsible for how you use or share the analysis

The Service is provided "as is" and without warranties.

6. Rewarded Ads & Third-Party Providers

To unlock analysis, PandaChecks may require completing a rewarded advertisement.

Ad providers may collect their own analytics and identifiers.

We are not responsible for:

• ad performance failures
• ad availability
• ad provider policies or tracking behavior
• revenue impact or payout delays in their systems

If an ad fails to load, users may need to retry.

7. Payments & Refunds (if paid unlocks are enabled)

All purchases are final unless otherwise required by law.

Refunds may be denied if:

• the analysis has already been generated, or
• the user attempts to abuse the refund system.

Chargebacks for valid purchases may result in account or IP restriction.

8. Rate Limits, Storage Limits, and Fair Use

PandaChecks may impose limits on:

• number of uploads
• file size and duration
• storage retention
• free-tier usage
• API or automated access (if introduced)

We may suspend or throttle abusive use at our discretion.

9. Prohibited Uses

You agree not to use PandaChecks to:

• violate any local, national, or international law
• generate defamation campaigns
• identify or target individuals
• produce manipulated content for harmful purposes
• analyze videos you do not have rights to
• create derivative datasets from transcripts or analysis
• attempt to hack, probe, bypass, or overload the Service

Violations may result in immediate termination.

10. Availability and Uptime

We strive for reliable uptime but do not guarantee:

• uninterrupted access
• error-free performance
• data retention
• preservation of old analysis results

Scheduled or unscheduled downtime may occur.

11. Intellectual Property

All trademarks, branding, logos, code, and design elements are owned by PandaChecks.

You may not copy, reproduce, modify, or resell any part of the Service without written permission.

12. Termination

We may suspend or terminate your access:

• for violating these Terms
• for abusive behavior
• for fraud or misuse
• for repeated chargebacks
• for technical/security reasons

You may stop using PandaChecks at any time.

Termination does not affect rights and obligations that remain after termination.

13. Limitation of Liability

To the maximum extent permitted by law:

• PandaChecks is not liable for any indirect, incidental, special, or consequential damages
• PandaChecks is not liable for loss of data, loss of profits, or reputational harm
• PandaChecks provides no guarantees regarding AI accuracy, ad performance, or system uptime

Your sole remedy for dissatisfaction with the Service is to stop using it.

14. Indemnification

You agree to indemnify and hold PandaChecks harmless from claims arising out of:

• your uploaded content
• your use of the Service
• your violation of the Terms
• your violation of any law

15. Governing Law

These Terms are governed by the laws of [Your Province/State, Your Country], without regard to conflict-of-law principles.
